AMENDMENTS TO SOME ARTICLES OF REGULATION ON SCHOOL CHANGE AND ADMITTANCE OF PUPILS TO LEARN AT MIDDLE AND HIGH SCHOOLS ISSUED TOGETHER WITH DECISION NO. 51/2022/QD-BGDDT DATED DECEMBER 25, 2002 OF THE MINISTER OF EDUCATION AND TRAINING OF VIETNAM

Pursuant to the Law on education of Vietnam dated June 14, 2019;

Pursuant to the Government’s Decree No. 69/2017/ND-CP May 25, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training of Vietnam;

Pursuant to the Government’s Decree No. 127/2018/ND-CP dated September 21, 2018 determining responsibility for state management of education;

At the request of the Director General of Secondary Education Department of Vietnam;

The Minister of Education and Training of Vietnam hereby promulgates a Circular on amendments to some articles of regulation on school change and admittance of pupils to learn at middle and high schools issued together with Decision No. 51/2022/QD-BGDDT dated December 25, 2002 of the Minister of Education and Training of Vietnam

Article 1. Amendments to some articles of regulation on school change and admittance of pupils to learn at middle and high schools issued together with Decision No. 51/2022/QD-BGDDT dated December 25, 2002 of the Minister of Education and Training of Vietnam.

“1. Middle education:

To be admitted to middle schools, pupils must have study result registers or certification of study result of the previous grades together with their schools' certifications that they have been permitted to higher grades.”

2. Clause 1 Article 9 is amended as follows:

“1. For Vietnamese pupils studying abroad then going home to study, they may be three years older than the age prescribed for each educational level.”

3. Point a Clause 2 Article 10 is amended as follows:

“a) The study result register or their schools’ certification of study result of the previous grades (the certified Vietnamese translation).

4. Clause 2 Article 14 is amended as follows:

“2. Age conditions

Foreign pupils may be three years older than the age group prescribed for each educational level in the year they apply for study in Vietnam

Article 2. Annulment of some points and replacement of some phrases of regulation on school change and admittance of pupils to learn at middle and high schools issued together with Decision No. 51/2022/QD-BGDDT dated December 25, 2002 of the Minister of Education and Training of Vietnam.

1. Annul Points c,d,g,h and i Clause 1 Article 5 and Point dd Clause 2 Article 10.

2. Replace the phrase “ngoài công lập” with the phrase “tư thục”.

Article 3: Entry into force

This Circular comes into force as of February 15, 2022.

Article 4. Responsibility of implementation

Chief of Office, Director General of Secondary Education Department, Heads of relevant units under the Ministry of Education and Training, Directors of provincial Education and Training Services, Heads of Departments of Education and Training, Principals of middle, high and combined schools, educational institutions that implement the General Education Program and relevant organizations and individuals shall be responsible for the implementation of this Circular./.
