DECISION

AMENDMENTS TO PROCEDURES FOR THE PROCESSING OF APPLICATIONS FOR SOCIAL INSURANCE BENEFITS AND PAYMENT OF SOCIAL INSURANCE AND UNEMPLOYMENT INSURANCE BENEFITS ENCLOSED WITH DECISION NO. 166/QD-BHXH DATED JANUARY 31, 2019 OF THE GENERAL DIRECTOR OF THE VIETNAM SOCIAL SECURITY

GENERAL DIRECTOR OF VIETNAM SOCIAL SECURITY

Pursuant to the Law on Social Insurance dated November 20, 2014;

Pursuant to the Law on Employment dated November 16, 2013;

Pursuant to the Law on Occupational Safety and Hygiene dated June 25, 2015;

Pursuant to Decree No. 89/2020/ND-CP dated August 4, 2020 of the Government of Vietnam on functions, tasks, entitlements, and organizational structure of the Vietnam Social Security;

At the request of the Director of the Department of Social Insurance Implementation and the Director of the Department of Finance and Accounting.

Article 1. Amendments to procedures for the processing of applications for social insurance benefits and payment of social insurance and unemployment insurance benefits enclosed with Decision No. 166/QD-BHXH dated January 31, 2019 of the General Director of the Vietnam Social Security:

1.Amendments to Detail b Paragraph 1.1.2 Point 1.1 Clause 1 Article 2:

“b) Prepare a list of recipients of lump-sum social insurance benefits covered by the provincial social security office; the list of recipients of lump-sum social insurance benefits in cash covered by postal authorities after being processed by the provincial social security office (in cases where beneficiaries apply for cash receipt at postal authorities).”

2.Amendments to Paragraph 1.2.3 Point 1.2 Clause 1 Article 2:

“1.2.3. Prepare lists of recipients of lump-sum social insurance benefits covered by the district-level social security office; lists of recipients of lump-sum social insurance benefits in cash covered by postal authorities after the processing of the district-level social security office (in cases where beneficiaries apply for cash receipt at postal authorities); list of recipients of support for training in professional skills according to its management of contribution collection.”

3.Amendments to Detail a Paragraph 2.1.2 Point 2.1 Clause 2 Article 2:

“a) Pay monthly pension and social insurance benefits; lump-sum social insurance benefits in cash associated with monthly social insurance benefits and lump-sum social insurance benefits in cash in case beneficiaries apply for cash receipt at postal authorities; make expenditures on unemployment benefits for workers.”

4.Amendments to Point 2.1 Clause 2 Article 7:

“2.1. Prepare lists of recipients of lump-sum payments

Every day, the Social Insurance Implementation Unit shall, based on the data on processed applications for lump-sum social insurance benefits (including lump-sum allowance associated with monthly social insurance benefits that beneficiaries apply for receipt via their personal accounts), notify the relocation of beneficiaries of lump-sum benefits for occupational accidents, occupational diseases, death benefits, and monthly pension and social insurance benefits associated with the lump-sum allowance from another district or province; decisions of competent state agencies on deduction of social insurance benefits, preparation of lists of recipients of lump-sum social insurance benefits (C97-HD List) by conducting payments via personal accounts or direct cash payments, presenting the lists to leaders for approval, or transferring the lists to the Planning and Finance Unit.”

2.1.2. Responsibilities of Social Insurance Implementation Division

“Comply with regulations prescribed in Detail 2.1.1 of this Point and transfer the lists to the Planning and Finance Division”

5.Amendments to Detail a Paragraph 2.2.2 Point 2.2 Clause 2 Article 7:

“a) List of recipients of monthly pension or social insurance benefits from the first day to the end day of the month (C72a-HD List), including lump-sum allowance in cash (if any), by conducting payments via personal accounts or direct cash payments”.

6.Amendments to Detail b Paragraph 3.1.1 Point 3.1 Clause 3 Article 7:

“b) Transfer the C97-HD List or recipients paid in cash by district-level post offices in the province to the provincial post office; transfer the C97-HD List (including the list of recipients paid by district-level social security offices and the list of recipients paid by district-level post offices) to the Planning and Finance Unit for payment, monitoring, and comparison for settlement with district-level post offices.”

7.Amendments to Detail b Paragraph 3.1.2 Point 3.1 Clause 3 Article 7:

“b) Transfer funding to provincial post office according to sum of social insurance benefits directly paid in cash by the post office as specified in the C97-HD List.”

“5.1.1. Receive the list of recipients and funding; make lump-sum cash payments of social insurance benefits according to the list of recipients sent by social security offices; pay monthly pension, social insurance benefits, and lump-sum social allowance in cash associated with monthly social insurance; manage beneficiaries; conduct reimbursement and implement reporting regulations according to the Vietnam Social Security and concluded contracts;”

9.Amendments to Paragraph 5.2.1 Point 5.2 Clause 5 Article 7:

“5.2.1. Make lump-sum cash payments of social insurance benefits according to the list of recipients sent by the social security office; pay monthly pension, social insurance benefits, and lump-sum social allowance in cash associated with monthly social insurance; manage beneficiaries; conduct reimbursement with district-level social security offices and implement reporting regulations according to the Vietnam Social Security and concluded contracts.”

Article 2. Social security offices of provinces and centrally affiliated cities shall adjust Contracts for the authorization of rights to pay social insurance benefits and unemployment benefits and manage beneficiaries of monthly social insurance benefits via the concluded postal system between provincial social security offices and provincial post offices consistent with contents amended by this Decision.

Article 3. This Decision comes into force as of November 18, 2022. Heads of units affiliated to the Vietnam Social Security, Directors of social security offices of provinces and centrally affiliated cities shall implement this Decision./.
